Because I find myself agreeing more often lately with the the New York Times editorial page.
The Times is right to criticize the administration’s permanent program to track money transfers via the international SWIFT system: It is unconstitutional, far exceeding any conceivable authority granted to the Executive.
Predictably, the Times is now under assault by National Review and legions of right-wing bloggers, of which I used to be one (had a “Blogs For Bush” banner and everything). They’re wrong.
It’s simple. Apply the Hillary Test: Is this a power you’d want the president to have if her name was Hillary? If the answer is no, then it’s not a power any president should wield.
